Mr. McNamara, a founding member of the firm, was a federal prosecutor for 11 years for the United States Attorney in the Southern District of California, where he focused on major economic crimes and public corruption. He worked with Mr. La Bella on the Campaign Financing Task Force in Washington, D.C., from 1997 to 1998, investigating violations of federal campaign finance laws during the 1996 presidential election, and was the lead prosecutor in the Task Force's first indictment. Before entering public service, Mr. McNamara practiced with Finley, Kumble, where he focused on securities regulatory and litigation matters, civil litigation, corporate and foreign internal investigations, and white-collar criminal defense.
Since returning to private practice in 2002, Mr. McNamara has been involved in the civil and criminal arenas, representing individuals and major companies in complex civil and commercial litigation in federal and state courts, defending individuals and entities in regulatory investigations and enforcement actions, representing individuals and entities in white-collar criminal investigations and prosecutions, and conducting internal corporate investigations.
Mr. McNamara's recent work includes: obtaining preliminary and permanent injunctive relief for a large cable operator against a trademark violator; representing the chief executive officer of a hospital in a federal criminal prosecution and trial, resulting in the ultimate dismissal of the charges; and representing companies and individuals in Securities and Exchange Commission enforcement proceedings.
Mr. McNamara earned a B.S. degree in Business Administration from the University of Nevada in 1983. He received his J.D. degree from the University of San Diego School of Law in 1986, where he was Managing Editor of the San Diego Law Review. He served as law clerk to the Honorable Roger D. Foley, United States District Judge for the District of Nevada, from 1986 to 1987.
Mr. McNamara is a member of the bars of California, Nevada and the District of Columbia. He is admitted to the United States Court of Appeals for the Ninth Circuit, as well as the United States District Courts for the Central and Southern Districts of California. Mr. McNamara serves on the Board of Governors of the San Diego Chapter of the Association of Business Trial Lawyers, and is a member of the American Bar Association (Criminal Justice Section - White Collar Crime Committee) and the San Diego County Bar Association.
